The Right Way To Deal With Copycats

Have you ever been searching for something online, and found something that looked way too similar to one of your works?  If so, you probably got a sick feeling in your stomach and felt like you got totally ripped off.

The question then becomes, what do you do when it looks like someone has ripped off your content or your idea?

Step #1 – Determine Whether There Has Been An Infringement

First, you need to evaluate whether they actually stole something from you illegally, or whether they did something that was perfectly legal.

Many people think that they have been ripped off, when it was just their idea that was being modeled.

If another person just modeled after your idea, but didn't copy your actual work or your source code, then there is not likely any copyright infringement.

Only a patent can protect the idea itself. So unless you had the idea patented, then others can model after your ideas without violating your copyright interests.

Copyright infringement occurs when someone has access to your work and copies a substantial portion of the protectable elements.

That means that they would have needed to see your work, and then copy a substantial portion from it (whether that be the text or underlying source code).

There are lots of online tools that make it easy to find out if someone has stolen your content. One example is Copyscape.  Copyscape lets you paste the URL of an article into the tool and then it gives you a list of any other web sites that contain a substantial portion of the same words. You can also perform a Google search to see if your content has been copied.




If you learn that someone really did steal a substantial amount of your work (your content and/or source code), then you should continue with the process below to determine how to handle the potential infringement.

Step #2 – Consider Filing A U.S. Copyright Registration

The next step is to consider filing a U.S. copyright registration.

You can earn a copyright in the U.S. by just creating the work, but you can get stronger copyright interests by filing a federal copyright registration with the U.S. Copyright Office.



For example, if you get a federal copyright registration before the particular infringement occurs, then you could get statutory damages and attorney fees awarded in addition to just the actual damages.

Before you are allowed to sue someone for copyright infringement in a U.S. federal court, you must have a federal copyright registration certificate to attach to your lawsuit.

You should consider filing a federal copyright registration on your most valuable products, but it would not be practical to file one for every single article that you write. And you probably wouldn't spend the money to sue someone for copying one single article from you, anyway.

There are still other things you can do to stop the pirates in their tracks, even if they stole just a small article from you.

Step #3 – File a DMCA Complaint

Under the Digital Millennium Copyright Act, third party Internet service providers can also be held liable for copyright infringement if they receive a copyright infringement complaint and don't investigate it.

So you can submit DMCA takedown complaints to the service providers that the potential pirate is using to host your content.  Let's look at an example.

Suppose someone stole an article of yours and put it on a web site hosted by GoDaddy. You could submit a DMCA complaint to GoDaddy to let GoDaddy know that you believe that particular person stole your work.

GoDaddy will then investigate the issue and will let the potential pirate know that you have filed the complaint. The work then has to be taken down, or the potential pirate has to respond and claim that the work is theirs.

This is just one example. You could also submit DMCA complaints to providers like Paypal, file sharing sites, etc. You can look on the ISP's web site for a link to their DMCA policy. Their DMCA link is often found right at the bottom of their home page, or linked to from their Legal Policies.

You just need to make sure that whatever service provider you submit the DMCA complaint to is someone that is actually hosting or otherwise interacting with the potentially infringing content. Otherwise, they do not have any duty to look into the matter.

You also need to make sure that you don't submit a DMCA complaint unless you really believe that your work was stolen. You can get intro trouble for submitting false complaints.

It is also important to be aware that if the potential pirate does respond back and claim the work is theirs, the service provider is off the hook and no longer has to deal with the issue.  You would then have to hire an attorney to pursue the pirate through a cease & desist letter and/or legal action.

But that is generally not necessary. The DMCA process tends to resolve about 80-90% of the piracies, and is something you can generally do without hiring an attorney.

Step #4 – Consider Hiring An Attorney For More Advice

If you need additional help, you should consider hiring an intellectual property attorney to advise you on the options. They can help you understand whether there was really an infringement of your rights, and/or send cease & desist letters to the potential pirate. They can also assist you in pursuing legal action if necessary for your situation.

Here's the bottom line. Just make sure someone actually infringed your rights before you go after them.  But if they really stole from you, there are several ways you can stop them, including using the highly effective DMCA process.

Your Thriving Business Assignment

If you think that someone has ripped off your work product, here are some steps you can follow to address the situation.

1.  Determine whether there has been an infringement. Just because someone created something similar to yours doesn't mean they did anything wrong. In order for there to be copyright infringement, someone else had to access your work and copy a substantial portion of the protectible elements from it.

2.  Consider filing a U.S. copyright registration. You can consider filing a copyright registration on your most valuable products.  This can provide additional advantages in the event of a piracy in the future.

3.  File a DMCA complaint. Even if you never obtain a federal copyright registration, you can still file a DMCA complaint with ISP's that are hosting material that infringes your copyright.

4.  Consider hiring an attorney for more advice. You should always consider hiring an attorney with experience in this type of matter if you need additional help resolving your situation.

3 Powerful Ways To Leverage Your Existing Content

We all know that one of the keys to increasing sales for your business is to drive more potential customers to your web site. It is all about getting more eyeballs to view your products or services. A great way to do this is by leveraging the content that you have already created and reformatting it so that it can be listed on Amazon.

Amazon is a powerhouse and gets millions of visitors each day that are looking to "buy products". Most of these shoppers are just "one-click" away from making a purchase. And Amazon's Kindle Store is no different.

With the popularity of Amazon Kindle eReaders, more and more people are downloading books, magazines, and newspapers from Amazon's Kindle Store. If your business is content driven, then there is no better time to re-purpose your existing content to gain further exposure for your business.

So, let's look at three strategies you can use to re-purpose your existing content and leverage Amazon Kindle and its publishing platforms to gain additional exposure for your business.

Strategy 1:  Amazon Kindle eBooks

One of the great ways to re-purpose your content is create an eBook from existing articles. The length of an eBook article can be long or short, depending upon your existing content.

For example, Denise and I are currently using this strategy by re-purposing our twice-weekly newsletters and publishing each article as an eBook through Amazon's Kindle Direct Publishing. We have also added more graphics to each article to provide more value to the reader, which in turn also makes the length of the article longer.

We also have used eye-catching graphics and a creative design on the cover of each eBook so that they stand out and grab the attention of a potential customer.

In the coming weeks, we will be publishing numerous eBooks of our re-purposed twice-weekly newsletters. So be sure to watch for these eBooks on Amazon Kindle and let us know what you think.

Since we are going to be creating the newsletters anyway, it makes sense that we spend just a few extra minutes on each newsletter to also format them for Kindle.  That allows us to gain even more exposure from the work invested in creating the newsletters.

Think about all of the content that you have already created that could easily be reformatted and repurposed as a Kindle eBook. You may be surprised at how much content you have already created.

Another way to get free publicity and exposure for your business using Amazon is by submitting your blog feed to Amazon Kindle.

Remember the Kindle announcement from Jeff Bezos, Founder of Amazon, which we've been talking a lot about in the past few months?

It's one of the biggest developments since the launch of the web!

And it could radically change your bank account if you make it work for you (or leave you in the dust if you ignore this important consumer spending trend).

Strategy 2:  Amazon Kindle Blogs

Amazon now gives you the ability to submit your blog so that people can find it when searching for other content or products on the site. They require you to charge readers a small fee for the blog feed, and you then get paid your share for any people who do subscribe. But even if you never get a single subscriber, there are great ways to leverage this opportunity.

For example, you can get free publicity for your blog, and drive people directly to your blog even if they don't subscribe through Kindle. Let's look at an example of how to do this.

For the Business Thrival newsletter that Denise and I publish 2 times per week, we submitted it as a blog to Amazon Kindle. An example is shown below.


Notice how our company name is listed as BusinessThrival.com. This allows people to find us directly even if they don't buy through Amazon or whatever site they see us on.

In this example, I located our blog by typing "Business Thrival", since I knew that is what the blog was called. But you can literally get your content found on any type of key word that you want people to find you under. You just put your desired key words in the blog title.

If you have a blog or newsletter that you update regularly, you should definitely consider listing your blog through Amazon and/or listing several of the articles as separate Kindle books as I described in Strategy #1.

A third way to leverage Amazon Kindle for your business is through magazines (and don't worry, you don't have to publish a magazine to take advantage of it).

Strategy 3:  Amazon Kindle Magazines

If you publish a newsletter on a regular basis like Denise and I do, you can submit your newsletter (blog) feed to Amazon as a Kindle Magazine.

To publish your newsletter or magazine on Amazon Kindle, you start with creating a new Amazon Kindle Publishing account. You then have to fill in a bunch of details about your newsletter, such as how frequently it is published. You need to pick a schedule that you know you can meet, because Amazon will pull each issue on the schedule you set.

You then just enter the URL of your blog feed for your newsletter, and generate a preview to make sure everything looks correct. They have interactive help and email support to help guide you through the process if you get stuck.

You can get great exposure for your web site even if no one subscribes to your magazine directly on Amazon. You just want to set up your account and description in a way that it makes it easy for people to find you directly. The way we did this is by listing BusinessThrival.com as the company name.

If you have lots of existing articles, or you create regular content for a blog or newsletter, you would be crazy not to list it on Amazon Kindle Publishing through one of these three methods.

And like I said before, even if you don't get a lot of people buying your book or subscribing to your blog or magazine, you will get some traffic directly to your site if you set it up the way I've explained in this article.

So there you have it. I hope you get started with re-purposing your content for Amazon's Kindle platform too and take advantage of the incredible exposure that it offers.

To leverage Amazon Kindle and its publishing platforms to gain exposure for your business by re-purposing existing content, follow these three strategies:

1.  Create a Kindle eBook from existing articles, newsletters, or content.

2.  Submit your blog so that people can find it when searching for other content or products on Amazon.

3.  Submit your newsletter (blog) feed as a Kindle Magazine.

Exercising can be so boring sometimes. I've talked before about the fact that easiest way to stay in shape is to find exercises that are fun. With today's world of technology, there are so many interactive exercise games you can play to make exercise fun again. For example, there are virtual golf games where you can golf inside, virtual bicycling where you can bicycle through Europe or other beautiful places right from your home, and exercises that you can do interactively, such as with the Nintendo "Wii Fit Plus".

Mind:

Before you go to bed each night, clear your mind and then ask yourself one question that you would like to have answered. Repeat the question to yourself a few times, and then allow yourself to drift off to sleep. You will be amazed at what your sub-conscious mind can do when you pose a question to it, and then rest your mind to allow it work on answering your question. Often times, the answer will pop into your head when you wake up. For more complex questions or issues, you may need to ask the question over a period of time.  But keep repeating the process, and let your sub-conscious mind work while you are sleeping.

Spirit:

On a hot summer day, there are a lot of things you can do to have fun and also cool off.  Here are just a few examples: Have a water-balloon fight. Go to a water park. Go to an air-conditioned theater. Buy a kiddie pool and have a pool party. Put your t-shirt in the freezer before wearing it.  :)  But most importantly, have fun.

7 Steps To Establishing Yourself As An Industry Leader

In the summer of 2000 I was finishing up my master's thesis in Exercise Physiology at McMaster University in Hamilton, Ontario (Canada's 'steeltown'). At the time, I lived with two buddies, and the only computer with Internet access in our house was in my friend's room in his basement apartment.

One Saturday afternoon, after getting home from running tests in the lab, I noticed my roommate was out at one of his Kung Fu classes, and so I went down to look for job opportunities on a fitness website.

It was during this fateful Internet search that I stumbled across the email address of the fitness editor for Men's Health magazine, the biggest fitness publication in the world. I decided to take a chance and send him my latest fitness email newsletter, even though it had only 150 subscribers.

A few days later the editor replied back, and wanted to use a piece from my article in an upcoming issue. Just like that I had instant credibility. This one opportunity would be the foundation for the exponential growth of my fitness information publishing business over the next 10 years. It allowed me to become a leader in my industry, and that has made all the difference.

And today we're going to cover my favorite advanced leadership mindset and marketing tips I was taught by one of my mentors, Dan Kennedy. These 7 steps will help you break the 6-figure and even 7-figure barriers in your business by establishing yourself as leader in your industry and niche market.

1) You Must Have Extreme Self-Confidence

Your business is not only about selling your product. It's also about attracting people who want everything you have to offer. Your business is YOU. It doesn't matter if you run a shop on main street in your town or a website serving people from all over the globe, you must be confident that what you bring to the world is unique and different from everyone else offering similar products.

2) You Must Take Action and Implement What You Learn

This step is not nearly as much fun as thinking big, but it is just as essential. The most successful people in the world are action takers. They don't think too much, they just get it done. If you're struggling with implementing what you know, then set more deadlines in your business. If you already have deadlines, cut them in half. Be bold. If you have a product planned for release in 3 months, cut that back and set a deadline of 2 months. You'll find a way to get it done and you'll be one step closer to being a leader in your industry. Life rewards action.

3) You Can Never Be Satisfied

You can never rest or try to sustain status quo. As Kennedy says, "You must be finding the replacement for the replacement."

If you are a salesperson having a record year, you must still be looking into the future and planning for when sales aren't as easy. You must continue to stay hungry and remain on top of the trends in your industry.

Likewise, if you're an online information marketer, it doesn't matter if you are getting 10,000 visitors per day to your site from Search Engine Optimization and affiliates, if you don't keep coming up with new stuff, eventually your traffic will dwindle and your business will die.

Keep learning and networking, and never be satisfied as long as you remain in business.
While millions of Americans go off to work every day, a select group of insiders are busy generating real income in a very different way.

These people have no visible form of income or employment. And yet, many of them are able to generate income well beyond what most people think is possible.

It looks like a mystery. But that's only because so few people know about their world.

This world is something you might call, "the underground economy."

4) Really Big Thinking – "Make no little plans"

This is my favorite step on the list. I just love to think big, and to plan and predict future opportunities for my business. It's a great exercise to do on airplanes, because research shows we're more creative when we get outside of our daily work environment – plus, it's much more productive than watching a movie you've seen before.

When it comes to big thinking, always be conceive and believe that you will achieve great plans. You must be sure of yourself that you will dominate your chosen niche. You must not be afraid to create bigger and bolder ideas everyday and always be looking for markets where you can charge top dollar, and bigger projects and products that will allow you to do so.

5) You Must Work on the Macro and Micro Components of Your Business

Everyone wants to be the "idea guy", but if you want to succeed you have to force yourself to be good at ideas, follow through, and details. You need to have every aspect of copy, product creation, and lead generation in place if you want to create a 6-figure or 7-figure income.

6) You Must Develop Multiple, High-Value Skills

It's not enough to be just a good speaker, or salesperson, or product creator. We need multiple skills. First we have to identify an opportunity, then generate leads, then build interest in our prospects, then persuade our prospects to become customers, and finally deliver extreme value and service. Don't just stop when you've become good in one area of expertise.

You also need to develop the skill of learning how to say NO. Too many folks spread themselves too thin, so you have to decide what projects are right for you and will advance your business.

7) Always Focus on Strategic Associations

If you sit at home and think you can avoid seminars and mastermind groups yet still develop powerful affiliate and business relationships, you are sorely mistaken. You need to be at seminars, having conversations in the hallways and at the bar, meeting new people online and offline.

Listen, by nature I'm an introverted person. A highly introverted person. I'd much rather read a book than introduce myself to a stranger. But guess what? Of all the strangers I've introduced myself to at the dozens of conferences I've attended, not one of them has bit me. And many of them have become friends, and a few of them have become lifelong business partners.

In fact, I might never have had my chance to run Early to Rise if it wasn't for a Mastermind group I joined where I met Matt Smith, my business partner. So get out there. Go to seminars and events. Plan ahead and have a list of people to meet and questions to ask AND people that you can help. Never go empty handed or without a plan.

Follow those 7 steps to start building a serious business and you'll soon join the ranks of leaders in your industry.

To improve you overall fitness, you do not have to sweat it out at a gym. Instead you can take a walk, ride a bike, go for a swim or even play golf. The key is to just keep moving to make a difference.

Mind:

Don't be so predictable. When you get into a routine, your brain adjusts and is not stimulated any more. To offset that, do something that breaks your pattern. For example, when driving to work take a different route instead of the usual route.

Spirit:

A great way to lift your spirits is to watch the sunset or the sunrise. Take time out of your busy day to stop and enjoy the sunset. Or, wake up an hour earlier to watch the sun rise. This will put you in a good mood and lift your spirits.

Use Tweet To Grow Your Business

You have probably heard the stories about people posting a video to YouTube or Facebook and it becoming the most sought after sensation overnight. These social media sites reach millions of people each and every day, and have the power to give anyone exposure to the masses for absolutely no charge.

Twitter is another social media powerhouse that has a vast audience and can also help you grow your business.

In fact, every day, millions of people also use Twitter as a means of communication to talk about what's happening in their personal lives, to share helpful tips and advice from experts, to chat about the recent scandals involving celebrities and politicians, and to discuss the most latest and greatest gadget that you simply must have. People, including your customers, simply tweet about everything.

But let's be realistic. It really does take consistent effort with these social media channels if you want to see the real benefit.

So, let's look at three simple strategies you can use to leverage Twitter to grow your business.

Strategy 1: Build Relationships With Customers and Prospective Customers

One of the most important reasons to use Twitter for your business is to build relationships with people. This includes your current customers, as well as potential customers. An easy way to do this is to set aside time weekly to find good things to tweet about.

If you don't have a large following yet, a great way to meet new people on Twitter is by engaging in conversations with others by using the @reply feature. You simply search for topics that you find interesting, and then comment back using @reply. You will quickly build a rapport with those who want to learn more about you, including your business, and they may follow you in return so they can view your future tweets.

You can also let your customers know about what is going on in your business. Whether it is an announcement about a new product, a special promotion you are offering for a limited time, or an upcoming event they may be interested in. Using Twitter to connect with your customers is simple.


Twitter allows you to hear what others are saying about your business, especially a dissatisfied customer. You can immediately address any concerns. It helps you to keep an ear to the ground about your company. It also helps you to know what your competition is doing, which is the next strategy.

Strategy 2: Know What Your Competition Is Doing

Always knowing what your competition is doing can help you grow your business. With Twitter, you can literally spy on your competition. You can read what customers are saying about your competition, good or bad…but especially bad.

For example, if a lot of people are tweeting about the poor customer service they received from your competitor, then why not take advantage of this? Tweet them and say, "hey I heard you are having a problem with this...did you know that my company also provides the same service but we value our customers and guarantee results." You will be amazed at how quickly people will respond and want to know more about your business. You can even use Twitter to build and strengthen your brand.

And if you see your competitor getting a lot of praise for certain things they are doing, you may want to look at offering some of those same features in your products. This will help you to build and strengthen your company brand.

Strategy 3: Build And Strengthen Your Brand

You do not have to be Coca-Cola, Nikken, or Microsoft for people to know who you are on Twitter. Twitter can help you build, strengthen and promote your brand regardless if you are a large or small business.

A quick way to do this is to make sure to customize your Twitter profile so that it says and looks the way you want it to. For example, make sure that your bio states who you are, what your business does, and that it links to your web site to allow people to learn more about you.

You can also tweet something that has to do with the internal workings of your business. Customers will chime in on the conversation, generating interest for others to learn more about your business. Word of mouth advertising is one of the most powerful advertising tools.

A feature within Twitter you can use to find out what people are saying, or not saying for that matter, about your business is Twitter Search. With one click of the mouse, you can hear from real people about what they are looking for.

For example, if you have a product that fits a need that people are talking about, then introduce yourself and begin a conversation. Start by talking about yourself first so that they get to know you. Once this happens, slowly start introducing your business and the product or services you offer. This will build your brand with them. This same approach can be used to strengthen your brand.

So there you have it. In a nutshell, Twitter can provide your small business with another channel to inform and engage your current and potential customers to grow your business. Happy Tweeting!
